Privacy Policy

1. Minimum Age

You must be at least 13 years old to create an account and play. Denmark sets the age of digital consent at 13 under Article 8 of the GDPR, and this is the consent we rely on to process your data.

If we learn that an account belongs to someone under 13, we delete the account and its data. A parent or guardian who believes their child has created an account can ask us to remove it at Support@toph.dk.

2. Data We Collect

We collect the following information when you use our game and website:

  • Email address — used for account authentication, email verification, and password recovery.
  • Username — chosen during registration, displayed in-game to other players.
  • Gameplay data — cities, armies, research progress, mission history, and other in-game actions stored on our servers.
  • Avatar selection — your chosen avatar identifier.

3. How Data Is Stored

All data is stored in a database hosted in the EU region. Data is encrypted in transit (TLS) and at rest per the hosting provider's security standards.

4. Cookie Usage

This site uses strictly necessary session cookies only. These cookies contain your tokens, are not accessible to JavaScript, and are required for authentication. We do not use any tracking cookies, advertising cookies, or third-party cookies.

5. Diagnostics and Performance

We send diagnostic logs to a third-party log provider (BetterStack) so we can find out when something breaks. These records contain the type of error, the page it happened on, and anonymous page-performance timings. They do not use cookies, do not include your IP address, and are not used to build a profile of you or to track you between visits.

6. Your Rights Under GDPR

Under the General Data Protection Regulation, you have the right to:

  • Access — request a copy of the personal data we hold about you. Email Support@toph.dk from the address your account is registered under, and we will respond within one month.
  • Rectification — request correction of inaccurate personal data. Your username, email address and avatar can be changed yourself from your Profile page.
  • Erasure — request permanent deletion of your data. You can do this directly from your Profile page using the "Delete Account" feature.
  • Data portability — request your data in a portable, machine-readable format. There is no self-service export in the game yet; email Support@toph.dk from your registered address and we will send you your account and gameplay data as JSON within one month. Data about other players that happens to appear in your battle reports is not included.

7. Data Deletion

You can permanently delete your account and all associated data at any time from your Profile page → Danger Zone → Delete Account. This action is irreversible and removes all personal data, gameplay data, and cities.

8. Inactive Account Policy

Accounts that have been inactive for more than 2 years are permanently deleted, along with all of their data. In normal operation you will receive a warning email one month beforehand — after 23 months of inactivity — telling you the exact date, though we cannot guarantee advance notice for an account that is already past the 2-year period. Logging in at any point before deletion resets the period and keeps your account.

9. Limitation of Liability

  • Bolig Selvsalg is not liable for any user-generated content or interactions within the game or website.
  • Bolig Selvsalg is not liable for any damages arising from the use of the game or website, including but not limited to loss of data, loss of profits, or any other commercial or economic loss.
  • Bolig Selvsalg is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use the game or website.
  • Bolig Selvsalg is not liable for any damages arising from unauthorized access to or alteration of user data, including but not limited to personal information and gameplay data.
  • Bolig Selvsalg is not liable for any other damages not explicitly mentioned above.

10. Content Moderation

Bolig Selvsalg reserves the full right to determine, at its sole discretion, whether any user-generated content violates the terms of service or community guidelines, and to take appropriate action, including but not limited to removing content, issuing warnings, suspending accounts, or banning users.

Bolig Selvsalg is not responsible for monitoring user interactions or content within the game or website, but reserves the right to do so and to take action against any content or behavior that it deems inappropriate, harmful, or in violation of its policies.

11. Prohibited Conduct

The following conduct is strictly prohibited on the platform. Violations may result in warnings, temporary suspensions, or permanent bans at our sole discretion:

  • Hate speech and discrimination — any content or communication that promotes hatred, violence, or discrimination based on race, ethnicity, nationality, religion, gender, gender identity, sexual orientation, age, disability, or any other protected characteristic.
  • Racism and xenophobia — racial slurs, stereotyping, dehumanising language, or any form of racial or ethnic prejudice.
  • Harassment and bullying — targeting, intimidating, threatening, or repeatedly antagonising other players, including sustained personal attacks, doxxing, or encouraging others to harass someone.
  • Profanity and offensive language — excessive or directed use of vulgar, obscene, or sexually explicit language in usernames, city names, or any player-visible text.
  • Sexual content — any sexually explicit, pornographic, or otherwise inappropriate sexual content or solicitation.
  • Real-world threats and violence — threats of real-world violence, self-harm encouragement, or glorification of terrorism, extremism, or violent acts.
  • Impersonation — pretending to be another player, a staff member, or any real-world individual with intent to deceive.
  • Spam and disruptive behaviour — flooding, spamming, repetitive messaging, or any behaviour intended to disrupt the experience of other players.
  • Cheating and exploitation — using bots, scripts, automation tools, exploits, or any unauthorised software to gain an unfair advantage or manipulate game mechanics.
  • Account abuse — operating multiple accounts, sharing accounts, or trading, selling, or buying accounts.
  • Real-money trading — selling, buying, or trading in-game items, resources, accounts, or services for real money or other external compensation.
  • Illegal activity — using the platform to engage in, promote, or facilitate any activity that is illegal under applicable law, including but not limited to fraud, phishing, distribution of malware, or money laundering.
  • Privacy violations — sharing personal information of other players without their consent, including real names, addresses, phone numbers, or other identifying information.
  • Harmful misinformation — deliberately spreading false information intended to cause harm or confusion among the player community.

This list is not exhaustive. We reserve the right to take action against any conduct that we determine to be harmful to the community, even if it is not explicitly listed above.

12. Intellectual Property

Bolig Selvsalg has the full rights over the game and website, including all intellectual property rights. Users do not acquire any ownership rights by using the game or website.

13. Disclaimers

  • The game and website are provided "as is" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Bolig Selvsalg does not guarantee the accuracy, completeness, or usefulness of any information provided on the game or website. Users are responsible for verifying any information before relying on it.
  • Bolig Selvsalg reserves the right to modify or discontinue the game or website at any time without notice and is not liable for any consequences of such modifications or discontinuations.

14. Changes to This Policy

Bolig Selvsalg reserves the right to update this privacy policy at any time. Users are encouraged to review it periodically for any changes. Continued use of the game or website after any changes to the privacy policy constitutes acceptance of those changes.

If you do not agree to the terms of this privacy policy, you should not use the game or website.

15. Governing Law

This privacy policy is governed by the laws of Denmark. Any disputes arising from it will be resolved in the courts of Denmark.
